Thank you for your interest in our online store. The protection of your privacy is very important to us. Below we inform you in detail about the handling of your data.

1. access data and hosting

You can visit our websites without giving any personal information. Whenever you call up a website, the web server merely automatically saves a so-called server log file, which contains e.g. the name of the requested file, your IP address, date and time of the call, transferred data volume and the requesting provider (access data) and documents the call.

This access data is evaluated exclusively for the purpose of ensuring the trouble-free operation of the site and improving our offer. In accordance with Art. 6 Para. 1 S. 1 lit. f DSGVO, this serves to safeguard our predominantly legitimate interests in a correct presentation of our offer in the context of a weighing of interests. All access data will be deleted at the latest seven days after the end of your visit to our website.

Hosting services by a third party provider
In the context of processing on our behalf, a third party provider provides us with the services for hosting and displaying the website. All data collected in the course of using this website or in forms provided for this purpose in the online store as described below are processed on its servers. Processing on other servers only takes place within the scope described here.

"This service provider is located in the USA and is certified under the EU-US Privacy Shield. A current certificate can be viewed here. Due to this agreement between the USA and the European Commission, the latter has an adequate level of data protection for companies certified under the Privacy Shield". Since the ECJ has now passed the judgement that the Privacy Shield is no longer valid, we would like to point out that if you use this website, your data will continue to be sent to the above-mentioned servers and you expressly agree to this when using this online store.

2. data collection and use for contract processing, contacting and opening a customer account

We collect personal data when you voluntarily provide us with this information as part of your order or when contacting us (e.g. via contact form or e-mail). Mandatory fields are marked as such, because in these cases we need the data for the execution of the contract or for the processing of your contact and you cannot send the order or contact without their indication. Which data is collected can be seen from the respective input forms. We use the data you provide us with in accordance with Art. 6 Para. 1 S. 1 lit. b DSGVO for contract processing and processing your inquiries.
As far as you have given your consent according to Art. 6 para. 1 sentence 1 lit. a DSGVO by deciding to open a customer account, we will use your data for the purpose of opening a customer account.
After complete processing of the contract or deletion of your customer account, your data will be restricted for further processing and deleted after expiry of the tax and commercial law retention periods, unless you have expressly consented to further use of your data or we reserve the right to use data beyond this which is legally permitted and about which we inform you in this declaration. The deletion of your customer account is possible at any time and can be done either by sending a message to the contact option described below or by using a function in the customer account intended for this purpose.

3. data transfer

In order to fulfill the contract in accordance with Art. 6 para. 1 sentence 1 lit. b DSGVO, we pass on your data to the shipping company commissioned with the delivery, as far as this is necessary for the delivery of ordered goods. Depending on which payment service provider you select in the ordering process, we will pass on the payment data collected for this purpose to the credit institution commissioned with the payment and, if applicable, to the payment service provider commissioned by us or to the selected payment service for the processing of payments. In some cases, the selected payment service providers also collect this data themselves, if you open an account there. In this case you must log in to the payment service provider with your access data during the ordering process. In this respect, the privacy policy of the respective payment service provider applies.

We also use an external merchandise management system for order and contract processing. The data transfer or processing that takes place in this respect is based on order processing.

We use a shipping service provider that is based in a country outside the European Union. The transmission of personal data to this company is only carried out within the scope of the necessity to fulfill the contract.

The same applies to the transfer of data to our manufacturers or wholesalers in cases where they undertake the dispatch for us (drop shipment).

Data transfer to shipping service providers
If you have given us your express consent to do so during or after placing your order, we will pass on your e-mail address to the selected shipping service provider in accordance with Art. 6 para. 1 sentence 1 lit. a DSGVO, so that they can contact you before delivery for the purpose of announcing or coordinating delivery.

This consent can be revoked at any time by sending a message to the contact option described below or directly to the shipping service provider at the contact address listed below. After revocation, we will delete the data you have provided for this purpose, unless you have expressly consented to further use of your data or we reserve the right to use your data for other purposes that are permitted by law and about which we inform you in this declaration.
For shipping purposes, your data will be passed on to the appropriate agencies such as DHL, UPS etc. Please refer to the data protection information of our partners via their websites.

Data transfer for the purpose of age verification
If your order includes goods whose sale is subject to age restrictions, we will ensure that the customer has reached the required minimum age by using a reliable procedure involving a personal identity and age check. For this purpose the SCHUFA IdentityCheck is used on our website. This service is operated by SCHUFA Holding AG, Kormoranweg 5, 65201 Wiesbaden.
In order to ensure the required minimum age, individual personal data (e.g. name, address and date of birth) are transmitted to SCHUFA Holding AG. A so-called identity check with Q-Bit is then carried out, which has been positively evaluated by the Commission for the Protection of Minors in the Media (KJM) for age verification.
In accordance with Art. 6 Para. 1 S. 1 lit. f DSGVO, the data transfer serves to safeguard our predominant legitimate interests in ensuring that our services comply with the provisions of the law on the protection of minors and the statutory provisions on the protection of minors.
In this respect, a credit assessment is not carried out.

After complete processing of the contract and after expiry of the tax and commercial law retention periods, your data processed for this purpose will be deleted, unless you have expressly consented to further use of your data or we reserve the right to use your data for other purposes that are legally permitted and about which we inform you in this declaration.

Transfer of data to debt collection companies
In order to fulfill the contract in accordance with Art. 6 Para. 1 S. 1 lit. b DSGVO, we will pass on your data to a commissioned collection agency if our payment claim has not been settled despite a previous reminder. In this case, the claim will be collected directly by the collection company. In addition, the transfer serves to protect our legitimate interests, which outweigh our own interests, in the effective assertion or enforcement of our payment claim in accordance with Art. 6 Para. 1 S. 1 lit. f DSGVO.

4. e-mail newsletter and postal advertising

E-mail advertising with newsletter subscription
If you register for our newsletter, we will use the data required for this purpose or separately provided by you to send you our e-mail newsletter on a regular basis on the basis of your consent in accordance with Art. 6 para. 1 sentence 1 lit. a DSGVO.

You can unsubscribe from the newsletter at any time and can either be done by sending a message to the contact option described below or via a link provided for this purpose in the newsletter. After unsubscribing, we will delete your e-mail address from the list of recipients unless you have expressly consented to further use of your data or we reserve the right to use your data for other purposes that are permitted by law and about which we inform you in this declaration.

E-mail advertising without registering for the newsletter and your right of objection
If we receive your e-mail address in connection with the sale of a product or service and you have not objected to this, we reserve the right, on the basis of § 7 para. 3 UWG, to send you regular offers on similar products from our range of products by e-mail. This serves to protect our legitimate interests in addressing our customers in advertising, which outweigh any other interests.
You can object to this use of your e-mail address at any time by sending a message to the contact option described below or via a link provided for this purpose in the advertising e-mail, without incurring any costs other than the transmission costs according to the basic rates.

Postal advertising and your right of objection
Furthermore, we reserve the right to use your first and last name as well as your postal address for our own advertising purposes, e.g. to send you interesting offers and information about our products by letter post. This serves to protect our legitimate interests, which outweigh the interests of our customers, in a promotional approach in accordance with Art. 6 para. 1 sentence 1 lit. f DSGVO.

The advertising mailings will be processed on our behalf by a service provider to whom we pass on your data for this purpose.
You can object to the storage and use of your data for these purposes at any time by sending a message to the contact option described below.

5. use of data for payment processing

Credit assessment
If we make an advance payment, e.g. in the case of purchase on account, it is necessary to obtain identity and credit information from specialized service providers (credit agencies) in order to conclude the contract in accordance with Art. 22 Para. 2 letter a DSGVO. For this purpose, we transmit your personal data required for a credit assessment to the following company(ies):

SCHUFA Holding AG
Cormorant Path 5
65201 Wiesbaden

Appropriate measures to safeguard your rights, freedoms and legitimate interests will be taken into account. You have the opportunity to present your point of view and to appeal the decision by contacting the contact person described below.

After the contract has been fully executed, your data processed for this purpose will be deleted, unless you have expressly consented to further use of your data or we reserve the right to use your data for other purposes that are legally permitted and about which we inform you in this declaration.
